Acceptance of Terms & Conditions

These Terms & Conditions govern your use of the Mom's Campus Cleaners service and website. By using, visiting, or browsing the Mom's Campus Cleaners website, you accept and agree to be bound by these Terms & Conditions. If you do not agree to these Terms & Conditions, you should not use the Mom's Campus Cleaners service or website. These Terms & Conditions are an ongoing contract between you and Mom's Campus Cleaners and applies to your use of the Mom's Campus Cleaners service and website. These Terms & Conditions affect your rights and you should read them carefully.

Changes to Terms & Conditions

Mom's Campus Cleaners reserves the right, from time to time, with or without notice to you, to change these Terms & Conditions in our sole and absolute discretion. The most current version of these Terms & Conditions can be reviewed on the Mom's Campus Cleaners website. The most current version of the Terms & Conditions will supersede all previous versions. Your use of the Mom's Campus Cleaners website or continued use of our service after changes are made means that you agree to be bound by such changes.

Privacy

Any information submitted on the Mom's Campus Cleaners website is subject to our Privacy Policy, the terms of which are incorporated herein. Please review our Privacy Policy to understand our practices. The most current version of it can be found on the Mom's Campus Cleaners website.

Limitations on Use

You must be 18 years of age or older to subscribe to the Mom's Campus Cleaners service. Unless otherwise specified, the content on the Mom's Campus Cleaners website is for your personal and commercial use and we grant you a limited license to access the Mom's Campus Cleaners website for that purpose. You may not download (other than through page caching necessary for personal use), modify, copy, distribute, transmit, display, perform, reproduce, duplicate, publish, license, create derivative works from, or offer for sale any information contained on, or obtained from, the Mom's Campus Cleaners website without our express written consent. Any unauthorized use of the Mom's Campus Cleaners website or its contents will terminate the limited license granted by us. Disclaimers of Warranties and Limitations on Liability, Mom's Campus Cleaners service and website and its contents are provided "as is" and we make no representations or warranties of any kind with respect to the Mom's Campus Cleaners website, its contents or our service. We assume no liability or responsibility for any errors or omissions in the content of the Mom's Campus Cleaners website, any failures, delays, or interruptions in the cleaning schedules, any losses or damages arising from the use of the content provided on the Mom's Campus Cleaners website, or any conduct by users of the Mom's Campus Cleaners service or website. We reserve the right to dispatch a cleaning person in our sole and absolute discretion. We disclaim all representations and warranties, including, for example, warranties of merchantability, fitness for a particular purpose, and non-infringement. In addition, we do not represent or warrant that the information accessible via our site is accurate, complete or current. Mom's Campus Cleaners is fully bonded and insured. In case of accidental breakage of customer's personal property, Mom's Campus Cleaners will assist the customer in restoring what was broken. However, on the day of the cleaning, we ask that you remove any breakable, irreplaceable, and/or sentimental object from your room when the cleaner arrives and performs his or her duties. Objects excluded from our liability are cash, jewelry, one-of-a-kind objects or hard to find objects, art, antiques, electronics and schoolwork. Our liability covers us for up to USD $3000 for the breakage or damage to the object. If breakage or damage does occur, it is your responsibility to notify Mom's Campus Cleaners with in 48 hours. If you are unhappy, just inform customer service of the fact within 24 hours (one day) of the cleaning and we will send another cleaner to your house, free of charge.

It is your responsibility to sign in the housekeeper in the proper way to conform to your college or building's guest policy. If this means taking the housekeeper to the security booth and signing him or her in, then you must do so. We are not liable for any implications of the customer not following the proper protocol. Additionally, if the policy states that the resident must escort the housekeeper, then you must do so and cannot let the housekeeper walk around by him or herself. We are also not liable for the repercussions of creating duplicate copies of a key or identification card or providing the housekeeper with the original copy to gain access to the building. We ask that you stay with the housekeeper during the cleaning process to supervise him or her. If you wish to appoint someone in your stead, please alert your housekeeper at the time of cleaning of this change. Whoever is in charge must ensure the respectful treatment of our housekeeper by both the customer and anyone else in the room or building at the time. If our housekeeper is attacked, either verbally or physically, we reserve the right to permit that housekeeper to leave the premises in the middle of the cleaning. Safety is our utmost concern and we want to ensure that safety for our housekeepers. Our housekeepers are people, and we ask that you treat them with the respect that any other guest to your house should deserve. In no event shall Mom's Campus Cleaners, its shareholders, directors, officers, or employees be liable (jointly or severally) to you for any special, incidental, indirect or consequential damages of any kind, or any damages whatsoever resulting from loss of use, data or profits, whether or not advised of the possibility of damage, and on any theory of liability, arising out of or in connection with the use or performance of the Mom's Campus Cleaners website, its contents or our service. If any applicable authority holds any portion of this section to be unenforceable, then liability will be limited to the fullest possible extent permitted by the applicable law.

Referral Policy

By enrolling in the Mom's Campus Cleaners service, you agree not to hire a housekeeper who is currently working at Mom's Campus Cleaners or who has worked with Mom's Campus Cleaners in the past. Doing so can result in immediate suspension of Mom's Campus Cleaners service and/or result in legal and/or punitive action. Our referral fee is $5,000 and we ask that you contact our customer support in case you wish to hire a Mom's Campus Cleaners housekeeper on your own.

Billing

Payments:

For your convenience, Mom's gladly accepts the following forms of payment: MasterCard/Visa, major credit cards, money order or cash. Customers will need to pay for their cleaning at the time of service. One-time cleaning requires a credit card payment, money order, or cash. Customers may leave a credit card number in a secured file with Mom's to use in the event you forget to leave your payment on the scheduled cleaning day. A $10.00 non-payment fee will be incurred if payment is not made on the scheduled service day, and a $25.00 fee is applied to all returned checks. If you use a credit card, your account will be charged the balance due, plus any fees, after each cleaning.

Customers pay the charges agreed upon prior to service. All billing shall be handled through the set up of the customer's account online. All laundry turned in to Mom's by an authorized user of that account will be cleaned and if any extra pound charges and or dry cleaning charges will be added directly to this account and the customer charged accordingly without seeking continual and additional charging permissions weekly. Mom's cannot be responsible for limiting authorized users in any way shape or form.

Cancellation

You may cancel your services with Mom's Campus Cleaners at anytime, and cancellation will be effective immediately. To cancel, just contact our customer support department to initialize the process. We will provide you with a refund for the unused service credits, but not the used ones. Unused service credits refer to services in which have not yet occurred but may be already scheduled. We reserve the right to retain administrative fees up to 20% of the cost of services with Mom's Campus Cleaners. We also reserve the right to terminate your account for any or no reason at any time. Cancellation in Laundry

If you do not like our service, wish to discontinue use, cancel, or Mom's terminates your contract. We will be happy to credit your account in the appropriate amount. You will be billed a 15% processing fee of the original cost for services, as well as $1.25 per pound for any used laundry services. If a client reissues services, without a verbal or written statement of intent for specific plan services, the client will be reassigned to the same service plan from the prior term and will be charged the full amount of the service plan. Cancellation in Home Cleaning

If you find it necessary to cancel or reschedule a cleaning time, you must notify Mom's no less than 24 hours before the scheduled day. This will allow us to reassign the service provider or team to another appointment. If Mom's receives less than 24 hours notice, or can't access your home at time of appointment, you will be charged a fee of 15% to the full price of your cleaning for that day of services. If you do not like our service, wish to discontinue use, cancel, or Mom's terminates your contract. We will be happy to credit your account in the appropriate amount. You will be billed a 20% processing fee to the original cost of your planed services, as well as the one time cleaning cost for each cleaning service already completed. To ensure that all your needs are addressed, please correspond all requests and changes directly to your Mom's office manager. If it becomes necessary for you to cancel services with Mom's please do not communicate these important details with our service agents. If for some reason you wish to terminate your Mom's services, please be sure to submit this verbally, through email, or in writing to: P.O. Box 40371, Tucson. However, we want you to be 100% satisfied with Mom's. Please see our 24 hour guarantee if you are dissatisfied with your cleaning. There are no refunds for gift certificate purchases.

Laundry & Dry Cleaning Terms and Conditions

This agreement is a legally binding contract entered into by and between you the "Client" and Mom's Campus Cleaners LLC. The following is the terms and conditions for use of any services which may be offered by us. Please read this agreement carefully. Mom's Campus Cleaners and its management, in the regular course of providing services to you, will be the only person's authorized to use your customer information. We do not sell or provide to third parties our client lists or any of our customer's personal information.

Pick Ups and Deliveries

Pick ups and deliveries will be attempted during normal business hours as determined by Mom's. Mom's reserves the right to determine the pick-up and drop-off times and locations at its discretion and reserves the right to reschedule such times and locations. A Mom's employee will accept all laundry that has already been paid for. Each student must check in with a Mom's employee located at their specific drop off spot. Mom's Campus Cleaners reserves the right not to pick-up items that are not in a Mom's bag. Customer agrees not to include (I) non-washable items in the laundry bag, (ii) items that are labeled for hand wash and/or dry-cleaning only in their Laundry Only bag (iii) any other items not meant for laundering or dry-cleaning in, or attached to any of the items to be cleaned or inside any of the bags. Customer is responsible for any and all damage caused by any items left in its clothing or in the bags that cause any damage to the clothing, cleaning machines, or anything else. . If we happen to find DRY CLEAN ONLY garments turned into the laundry with your regular wash they will be dry cleaned and the charges will be billed to your account unless other instructions are provided by you prior to time of washing. However, if you turn in a dry clean only garment and do not alert Mom's that it is with your clothes, Mom's can not be responsible for liability arising from the manner in which it is cleaned.

Bleach or Name Brand Products

We will not use bleach on clothing items unless requested and initialed upon ordering services. If you request us to use bleach or named brand products on clothing items, please be aware that we will not be held responsible for any damages caused by bleach or any products.

Dry Cleaning

Items to be dry cleaned must be contained separately from laundry items, and placed in your Mom's dry cleaning bag. Each customer must thoroughly complete a Mom's inventory sheet, and place it in their dry cleaning bag. Failure to complete a Mom's inventory sheet will relieve Mom's of any and all liability arising from the methods used to clean these garments as well any items missing from your Mom's dry cleaning bag. If we happen to find DRY CLEAN ONLY garments turned into the laundry with your regular wash they will be dry cleaned and the charges will be billed to your account unless other instructions are provided by you prior to time of washing. However, if you turn in a dry clean only garment and do not alert Mom's that it is with your clothes, Mom's can not be responsible for liability arising from the manner in which it is cleaned.

Missing Items & Damaged Items

Although Mom's is not liable for damage to or loss of clothing due the fault of the third party cleaners or service providers, if Mom's at its sole discretion desires to, Mom's will reimburse Customer for lost or damaged clothing in an amount to be determined by Mom's . All claims regarding garments missing while in our care must be made within 3 days of the laundry pick up date, and must be accounted for on a Mom's inventory sheet. If the item is not listed on a Mom's inventory sheet or is reported after this time period Mom's can not be expected to monitor the laundry in question through the washing system and cannot be held responsible for claims relating to this pick up. Mom's reserves the right to refuse cleaning any garment. Mom's is not responsible for any valuable items left in pockets or otherwise turned in with any laundry orders, but if found the customer will be contacted by Mom's . Mom's does not guarantee removal of all stains. Mom's will not be held responsible for any damage brought about through wear and tear from ordinary wash and dry operations. Any shrinking of clothing not specified for special care will not be the responsibility of Mom's. Mom's will not be responsible for any damage originating from ink pens or other items left in laundry pockets. Additional stains found on clothing must be inspected by Mom's. Many Stains Become more visible after being exposed to the heat of the normal drying process and determinations as to the origins of these stains and corresponding liability thereof will be made solely by Mom's.

Service Providers/Disclaimer of Certain Liabilities

Mom's or its associates will deliver Customer's items to and from a laundering and dry-cleaning service of Mom's choice. Mom's reserves the right to utilize any outsourcer, vendor, or outside service provider, for any service, at its sole discretion without notice to Customer. Mom's is not responsible and will not be held liable for any damage or loss due to the acts or omissions of its vendors, third party outsourcers, or service providers. Mom's liability under this agreement shall be limited to direct damages in an amount not to exceed the charges paid by the customer for the school term in which the damage is alleged to have occurred. In no event shall the Mom's be liable to any party for any indirect, consequential, or special damages, whether arising in tort, contract or otherwise, by reason of any services performed, or undertaken to be performed, or actions taken by Mom's, or its agents or employees.

Home Cleaning Terms and Conditions

Our work is guaranteed, however we do not offer a refund. If you are dissatisfied with our cleaning service for any reason, please contact us within 24 hours of your cleaning and we will return to clean the areas you are not happy with at no additional cost you. When you need extra services or additional cleaning on your schedule cleaning day, please call us 24 hours in advance to make sure we reserve the extra time we need in order to provide time for the additional service needed.

Arrival Notice

For your convenience we have a flexible schedule 5 days a week. Mom's Service will do our best to arrive on time at your home. Please note, since is not possible to give a specific time when we will arrive, we will make every effort to meet your needs. If you wish to wait for your provider to give them access into your home, please realize that we can give arrival windows of about 4 hours, such as 9 am - 1:00 pm or 11am - 3:00 pm. Many things can affect our schedules, such as cancellations, lockouts or customers adding services. We want to save you time, not make you waste it waiting for us to arrive. Leaving a key at the Mom's office is the most efficient way for you to provide your service provider access to your home

Safety Policy

Keys and Alarm Systems: Most Mom's customers leave a key to their home at our office, and we take extreme measures to protect each key. We assign every customer key a security code and store it in a key safe. Managers will access your key the day of your scheduled cleaning, and then return it to the safe by the end of the day. No identifying information is ever put on any key. Also for your safety, we do not return keys by mail. Customers must come in person to the Mom's office and present a picture ID before a key will be released. If you have an alarm system at your home and it is simple to operate, you can give instructions on its operation to your Mom's office. However, if your alarm system is complicated, we prefer that your alarm be left off on the day of the cleaning. Please refer to our breakage and loss policy for additional information

Employees

Our employees are very important to us, and we are very serious about keeping them safe, so they do not use ladders or move anything heavier than 35 lbs. These types of activities put our employees in danger of back injury or could even damage your flooring. If you would like us to clean behind appliances like a refrigerator, oven or sofa, please move it prior to the cleaning to allow access to the desired area.

Bleach or Name brand Products

We will not bring bleach into a home to use as a cleaning product. If you request us to use bleach supplied in your home, please be aware that we will not be responsible for any damage caused by bleach.

Tipping

Mom's never requires tipping, but it is a powerful way to say thank you to your service provider. Remember your appreciation need not be monetary. A personal note from you expressing your appreciation for their service can mean a great deal.

Breakage and Loss Policy

Mom's Campus Cleaners is fully bonded and insured. In case of accidental breakage of customer's personal property, Mom's Campus Cleaners will assist the customer in restoring what was broken. However, on the day of the cleaning, we ask that you remove any breakable, irreplaceable, and/or sentimental object from your room when the cleaner arrives and performs his or her duties. Objects excluded from our liability are cash, jewelry, one-of-a-kind objects or hard to find objects, art, antiques, electronics and schoolwork. Our liability covers us for up to USD $3000 for the breakage or damage to the object. If breakage or damage does occur, it is your responsibility to notify Mom's Campus Cleaners with in 48 hours. Key replacement / locksmith fees are paid only if keys are lost or miscoded. There is a $50 per location liability limit.

24 Hour Guarantee

Our work is guaranteed, however we do not offer a refund. If you are dissatisfied with our cleaning service for any reason, please contact local Mom's office within 24 hours of your service and we will happily clean the area with which you are dissatisfied. When you need extra services or additional cleaning on your schedule cleaning day, please call us 24 hours in advance to make sure we reserve the extra time we need in order to provide time for the additional service needed.

Referral Fee

Should you wish to hire a present or past Mom's staff member for any home related service outside of your agreement with Mom's, our referral fee is $2,500. This fee is due within 30 days of notification from Mom's. If the fee is not paid Mom's reserves the right to pursue other methods of collection.

Shipping and Packing Terms and Conditions

Shipping Services Terms and Condtion

Shipper expressly agrees to the terms and conditions set forth below: Shipper shall declare the value of the item shipped. If Shipper fails to declare a higher value, Mom's Campus Cleaners maximum liability for loss or damage of the item(s) shipped shall be One Hundred Dollars ($100.00). Shipper hereby releases Mom's Campus Cleaners, its employees, agents and third party vendors from any liability in excess of One Hundred Dollars ($100.00) in the absence of a declared higher value. If Shipper declares a value of the item shipped which exceeds One Hundred Dollars ($100.00), Shipper shall pay excess valuation charges based on applicable carrier. Shipper hereby accepts responsibility for notifying Consignee of the terms and conditions of this Contract, and hereby agrees to hold Mom's Campus Cleaners harmless for any loss or damage related to the shipped items in excess of that described in (1) and (2) above. In any instance of arbitration or litigation relating to this Contract, or the items shipped hereunder, the prevailing party shall be awarded its attorneys fees and costs. *Each Mom's Campus Cleaners owned and operated location. *Customer Packed Goods are insured only for the loss of an entire package. Mom's Campus Cleaners is not responsible for visible or concealed damage or for loss of goods from within any delivered package. *Price quotes are subject to size and weight verification. *All shipments are one person delivery only, unless stipulated in writing on the website. *Hazardous materials are prohibited. By oredering services, Shipper agrees to pay all sums due in accordance with the terms set forth therein. In the event that any payment required by services is not paid when due, Mom's Campus Cleaners shall be entitled to receive, in addition to the principal amount due, interest calculated at the rate of one and one-half percent (1.5%) per month, from the date of invoice until paid. Shipper agrees that, in the event any sums due under this service become subject to any collection activity, Mom's Campus Cleaners shall be entitled to receive all reasonable costs and expense of collection and/or suit, including but not limited to its attorneys fees and costs. Mom's Campus Cleaners may alter, amend or otherwise modify any term, provision or condition of the services. Any such alteration, amendment or other modification shall be void and of no force or effect. In tendering Shipper packed goods for carriage, Shipper warrants that the shipment is packed adequately to protect the enclosed goods and to ensure safe transportation with ordinary care and handling, and that each package is appropriately labeled and is in good order (except as noted) for carriage as specified. International air carriage is subject to the rules relating to liability established by the Convention for the Unification of Certain Rules Relating to International Carriage by Air, signed at Warsaw, October 12, 1929. Mom's Campus Cleaners liability with respect to this shipment is expressly limited to the maximum sum of One Hundred Dollars ($100.00) unless a higher value is declared and a fee is paid for such higher declared value. Except as otherwise expressly provided herein, Mom's Campus Cleaners liability is limited to the declared value of the shipment, the amount of invoice, or if there is not an invoice, then the actual cash value at the time loss or damage occurs, or the cost to repair or replace the property with material of like kind and quality whichever is lower. Where a Shipper declares a value that is less than the actual value of the shipment, payment upon any claim shall be limited to the proportion which the value declared by the Shipper bears to the actual value of the shipment. Shipper further agrees to indemnify, defend, and hold harmless, Mom's Campus Cleaners, its agents, employees, and assigns from and against any and all resulting claims, costs, expenses, damages, and liabilities (including attorneys fees) in the event Shipper fails to adequately declare the actual total value of the shipment. Mom's Campus Cleaners and/or its insurance carrier may at their sole option, any damaged item(s) to be repaired or restored by their designee and such repair and/or restoration shall exonerate Mom's Campus Cleaners and /or its insurance carrier from any further claims or damages whatsoever. In the event Shipper fails to declare the values per item on a multiple item shipment, the maximum amount that will be paid per item in the event of any claim shall be determined by dividing the total declared value of the shipment by the number of items in the shipment. Mom's Campus Cleaners is not liable for loss, damage, delay, misdelivery or nondelivery not caused by its own negligence; loss, damage, delay, misdelivery or nondelivery caused by (i) the act, default or omission of Shipper, Consignee, or any other party who claims interest in the shipment, (ii) the nature of the shipment or any defect, or any characteristic thereof, (iii) violation by Shipper or Consignee of any of the conditions of contract contained in this service, including, but not limited to improper or insufficient packing, securing, marking or addressing, or failure to observe any of the rules relating to shipments not acceptable for transportation or shipments acceptable only under certain conditions, (iv) acts of God, perils of the air, public enemies, public authorities acting with actual or apparent authority of law, acts or omissions of customs or quarantine officials, riots, strikes or other local disputes, civil commotions, hazards incident to a state of war or acts of terrorism, weather conditions or mechanical delay of aircraft, or (v) acts or omissions of any person other than Mom's Campus Cleaners, including compliance with delivery instructions from Shipper or Consignee. Further, Mom's Campus Cleaners shall not be liable for: (a) Shippers packed goods where there is loss or damage of articles loaded or sealed in packages provided by Shipper; (b) any mechanical failure of any electronics, musical instruments, appliances, clocks, radios, cameras, or other mechanical or electronic items of any kind or nature; (c) any claims for damage where such damage recurred in a place where prior damage existed, or where such prior damage was previously repaired or restored; (d) for any claims or damages resulting from or to finishes incompletely or inadequately cured or dried, or which were previously broken down from age, abuse, or otherwise; (e) any claims for loss or damage to abandoned goods or for shipments refused, delayed, re-delivered, mis-delivered, or not delivered by reason of the fault of the Shipper or Consignee, whether in the possession of Mom's Campus Cleaners, Carrier, or any third party; (f) any internal, unsecured or insufficiently secured, or other inherent vice contained within item(s) shipped which results in damage to item(s); (g) spoilage, contamination, freezing, rusting, extremes of temperature or air pressure, shrinkage, evaporation, change in flavor, appearance, or texture; or (h) damage caused by hazardous materials. Documentation of all claims other than overcharge claims must be submitted in writing to Mom's Campus Cleaners within 90 days after delivery. In the event additional documentation is required to evaluate the claim then Shipper agrees that such additional documentation must be submitted to Mom's Campus Cleaners within 9 months after delivery. No cargo, loss, or damage claim will be processed until all transportation charges have been paid. The amount of a claim may not be deducted from the transportation charges. Receipt of the shipment by Consignee without written notification of damage on the delivery receipt shall be prima facie evidence that shipment was delivered in good condition, except in the case of claims for concealed damage which is not discovered at the time of delivery. Shipper shall notify Craters & Freighters promptly in writing after the discovery of concealed damage and in any event no later than 12 days from the date of delivery. Shipper must make the original shipping cartons and packing available for inspection by Mom's Campus Cleaners. Claims for overcharges and refunds must be made in writing to Mom's Campus Cleaners within 30 days of the billing date. All claims must be filed by Shipper, and Shipper shall require its Consignees to (a) note all damages on the carriers delivery receipt, (b) retain all packaging materials, (c) provide photographs of the damaged items and the packaging materials, and (d) notify Shipper and Mom's Campus Cleaners of any loss or damage within the time(s) specified herein. Suits for loss, damage, injury or delay shall be instituted against Mom's Campus Cleaners no later than two years and one day from the day when written notice is given by Mom's Campus Cleaners to Shipper that Mom's Campus Cleaners has disallowed the claim or any part or parts of the claim specified in the notice. Where claims are not filed or suits are not instituted thereon in accordance with the foregoing provisions, then Mom's Campus Cleaners shall not be liable for such claim, and such claims will not be paid.Mom's Campus Cleaners normal routing shall be followed unless Shipper specifically requests and inserts herein specific routing to be followed by Mom's Campus Cleaners. Unless Shipper specifies to the contrary, the shipment tendered herein may, at the sole discretion of Mom's Campus Cleaners, be diverted to motor or other carrier. Shipper shall enter the amount of any Shipper, COD charges which shall be collected subject to the fees and rules of the delivering carrier. By clicking I Agree, Shipper agrees to all the terms and conditions stated in this agreement and additionally certifies that this cargo does not contain any unauthorized explosives, incendiaries or hazardous materials. Shipper consents to a search of this cargo. Shipper is aware that this endorsement and/or original signature, along with other shipping documents, will be retained on file for at least thirty days. Any problems encountered should be directed to the Mom's Campus Cleaners that handled your goods. Any legal action involving a lawsuit must be filed at the geographical origin of the Mom's Campus Cleaners location.SHIPPER REPRESENTS AND WARRANTS THAT IT IS NOT SHIPPING ANY ITEMS WHICH CONTAIN OR ARE COMPRISED OF HAZARDOUS MATERIALS, AS SUCH TERM (HAZARDOUS MATERIALS) IS DEFINED BY FEDERAL, STATE, OR LOCAL LAW. MOM'S CAMPUS CLEANERS SHALL NOT BE LIABLE IN ANY EVENT FOR ANY SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES, INCLUDING BUT NOT LIMITED TO, LOSS OF PROFITS, INTEREST, OR INCOME WHETHER OR NOT CARRIER HAD KNOWLEDGE THAT SUCH DAMAGES MIGHT BE INCURRED. WRITTEN NOTICE OF LOSS DUE TO DAMAGE OR SHORTAGE MUST BE REPORTED BY SHIPPER TO MOM'S CAMPUS CLEANERS WITHIN 5 DAYS FOR VISIBLE DAMAGE AND 12 DAYS FOR CONCEALED DAMAGE AFTER THE DELIVERY OF THE SHIPMENT. WRITTEN NOTICE OF LOSS DUE TO NONDELIVERY MUST BE REPORTED BY SHIPPER TO CRATERS & FREIGHTERS WITHIN 30 DAYS AFTER ACCEPTANCE OF THE SHIPMENT FOR CARRIAGE.

PACKING TERMS AND CONDITIONS

Packing Services In tendering this item(s) for packing, Client expressly agrees to the terms and conditions set forth on this Job Service Order. Mom's Campus Cleaners liability for any loss or damage to the item(s) is expressly limited to the sum of Fifty Dollars ($50.00) unless Client expressly declares a higher value and pays the cost of such valuation based on the actual total value of the item(s). Where a Client declares a value that is less than the actual value, payment upon any claim shall be limited to the proportion which the value declared by the Client bears to the actual value of the item. For example: An item valued at $50,000.00 is declared at $10,000.00 and there is a $6,000.00 claim presented. Mom's Campus Cleaners liability would then be limited to $1,200.00. The failure by the Client to declare a value in excess of Fifty Dollars ($50.00) shall relieve Mom's Campus Cleaners, its agents, employees, and assigns, of any liability in excess of Fifty Dollars ($50.00) for any loss or damage to the item(s). Client further agrees to indemnify, defend, and hold harmless, Mom's Campus Cleaners, its agents, employees, and assigns from and against any and all claims, costs, expenses, damages, and liabilities (including attorneys fees) in excess of the limits set forth herein in the event Client fails to adequately declare the actual value of items. See additional terms on the back of this Job Service Order.CLIENT HEREBY EXPRESSLY AGREES TO THE FOLLOWING ADDITIONAL TERMS AND CONDITIONS UPON TENDERING ITEM(S) FOR PACKING DESCRIBED HEREIN: By oredring Packing Service Order, Client agrees to pay all sums due in accordance with the terms set forth herein. In the event that any payment required by this Packing Service Order is not paid when due, Mom's Campus Cleaners shall be entitled to receive, in addition to the principal amount due, interest calculated at the rate of one and one-half percent (1.5%) per month, from the due date stated on the invoice. If a separate invoice is not received the due date is 30 days from the date stated on the Job Service Order. Client expressly agrees that, in the event any sums due under this Job Service Order become subject to any collection activity, Mom's Campus Cleaners shall be entitled to receive all reasonable costs and expenses of collection and/or suit, including but not limited to its attorney fees and costs.No agent, employee, or servant of either Client or Mom's Campus Cleaners may alter, amend, or otherwise modify any term, provision or condition of this Packing Service Order. Any such alteration, amendment, or other modification shall be void and of no force or effect. MOM'S CAMPUS CLEANERS LIABILITY WITH RESPECT TO ITEMS COVERED BY THIS JOB SERVICE ORDER IS EXPRESSLY LIMITED TO THE SUM OF $50.00 UNLESS A HIGHER VALUE IS DECLARED FOR VALUATION HEREIN AND A HIGHER CHARGE PAID. Except as otherwise expressly provided herein, Mom's Campus Cleaners liability is limited to the declared value of the item(s), the amount of the invoice or if there is no invoice, then the actual cash value at the time of loss or damage occurs, or the cost to repair or replace the property with material of like kind and quality, whichever is lower. This coverage is in effect only while the item(s) are in the care, custody, and control of Mom's Campus Cleaners. If no shipping documents are attached, Mom's Campus Cleaners will not be liable for any damages to the contents of containers. In the event Client should require a Mom's Campus Cleaners franchise to pack and ship the items within the containers manufactured by Mom's Campus Cleaners, then liability shall accrue in accordance with the contract terms of the Mom's Campus Cleaners services. In the event Client fails to break out the values per item on a multiple item job, the maximum amount that will be paid per item in the event of any claim shall be determined by dividing the total declared value of the job by the number of items in the job. Mom's Campus Cleaners is not liable for any damage not caused by its own negligence; or any damage caused by (i) the act, default, or omission of Client or any other party who claims an interest in the item(s), (ii) the nature of the item(s) or any defect, or any characteristic thereof, or (iii) acts of God, perils of the air, public enemies, public authorities acting with actual or apparent authority of law, strikes or other local disputes, civil commotions, hazards incident to a state of war, or weather conditions. Further, Mom's Campus Cleaners hall not be liable for: (a) any mechanical failure of any electronics, musical instruments, appliances, clocks, radios, cameras, or other mechanical or electronic items of any kind or nature; (b) any claims for damage where such damage recurred in a place where prior damage existed, or where such prior damage was previously repaired or restored; (c) for any claims or damages resulting from or to finishes incompletely or inadequately cured or dried, or which were previously broken down from age, abuse, or otherwise; (d) any claims for damages for abandoned goods, whether in the possession of Mom's Campus Cleaners, or any third party designated by Mom's Campus Cleaners; (e) any internal or other inherent vice contained within item(s) which results in damage to item(s); or (f) spoilage, contamination, freezing, rusting, extremes of temperature or air pressure, shrinkage, evaporation, change in flavor, appearance, or texture. MOM'S CAMPUS CLEANERS SHALL NOT BE LIABLE IN ANY EVENT FOR ANY SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, INCLUDING BUT NOT LIMITED TO, LOSS OF PROFITS, INTEREST, OR INCOME WHETHER OR NOT Mom's Campus Cleaners HAD KNOWLEDGE THAT SUCH DAMAGES MIGHT BE INCURRED. Mom's Campus Cleaners normal packaging procedure shall be followed unless Client specifically requests and inserts herein specific instructions to be followed by Mom's Campus Cleaners.
